This is not hunting, but perhaps might be interesting to some international members whom are unaware of this traditonal Australian Aboriginal practice.

Spear tradition loses out to a point of law

Jeremy Anthony was back in jail last night - after breaching bail so he could be speared in a traditional Aboriginal punishment for the death of his wife.

Anthony, 24, was arrested on Tuesday after being speared, in a case that highlights the dilemma of Aborigines caught between the tradition of payback and the Northern Territory legal system.

Lawyers in the case say the refusal of courts to acknowledge payback traditions in cases where they could lead to serious injury has added to tensions in Aboriginal communities.

Anthony, a traditional Warlpiri man, was arrested in Katherine after seeking treatment for spear wounds to a leg and a broken arm. He was refused bail in Katherine local court yesterday and will stay in custody until his committal resumes in May on charges related to his wife's death.

Police said he had breached bail conditions by visiting the community at Lajamanu, 800 kilometres south-west of Darwin, where police say he was speared for allegedly beating his wife, who died in her sleep in December.

In February the Supreme Court had released him on bail on condition that he would not visit Lajamanu. The court felt there was a risk he would suffer grievous bodily harm if the traditional punishment was meted out to him.

Anthony now faces charges of manslaughter and committing a dangerous act causing death while drunk.

They are only "traditional" when it suits them.

How about the bloke at a community out side Alice, he was speared then patched up by the community's ONLY nurse, so the community members attacked her and drove her out

Usually a spearing is to a thigh or upper leg, sometimes more than once.

Regarding the nurse, yes that community is very clever.

The real victim is the poor murdered wife.

Well we should atleast give them their traditions we took everything else from them !

We need to recignise and accept aboriginal tradition even if it is violent! we need to keep these people the way they are and keep their traditions alive!

IMO he is a wife beater so he deserved much more then getting speared i wont go into detail

Has any Australian Court in this case considered punishing the spearer, rather then the spearee ? Not that the canadian Courts make any better decisions when it comes to our natives.

I must respectfully disagree here SaHunter, if they are allowed to keep barbaric 'traditions' like this then how are they ever to be accepted into the community at large? Allowing Aborigines to live outside our laws and have their own special set of rules only serves to segregate them from the rest of the community. They are as far away from it now as is almost possible. They need to become a part of the community, not go around stabbing each other! If I were to do that to a family member for murdering his wife, I would be arrested too.

Unless you live here in the NT, you don't really understand, I see more crime here than anywhere else being commited by aborigines because they don't see themselves as a part of 'OUR' community and have no respect for us or themselves and it is a big shame. They have much to offer. Poverty is also a big issue, itinerants sleeping in the streets and parks and it all comes down to their respect for our community or their lack of it. They don't want to be a part of it, the children don't get educated and the parents don't have jobs (I will admit there are many who do and there are some really good indiginous people out there), it becomes a terrible circle that they need to pull THEMSELVES out of. The Govt has thrown more money at Indiginous Affairs than in the defence budget for many years and nothing has changed. I have no idea what should be done though.

I don't believe this practice should be allowed to continue, as said, it just alienates indiginous people from the rest of society and belongs in the dark ages not 2005.

What is needed is to elevate a sizable proportion of Aboriginal communities into a middle class. This socialis engineering where everyone is equal is a idiotic fantasy. And when I talk about a "middle class" I am not talking about a few receiving handouts (oops salaries) from gov'ts and Aboriginal organisations. I am talking about real jobs, real small businesses.

How to get there is anyone's guess, I have no idea, except to provide better education to those who are smart enough to use it. Scolarships etc to gifted individuals is a start.

Some improvements are quite simple. Shooting a lot of dogs in a desert community temporarily fixed a lot of health issues which lead to blindness, stomach disorders etc and ultimately life expectancy. ie some basic hygiene issues.

Temporary because the administrator who brought the programme in was removed after howls (pun intended) of protest.
