Accidental shooting insurance?
      #135587 - 18/05/09 03:49 PM

Is there any insurance available to the client hunter that would cover injury to others as a result of his shooting? Is this something SCI or NRA provides? In most countries I would expect the outfitter/guide be required to carry a liability policy that would cover his staff, but Africa seems to be the exception. And would the shooter have to be sued for the shootee to benefit?

Actually your homeowners policy provides coverage where if, through your negligence, you cause someone else bodily injury or property damage..it will pay up to the limit of the policy which is typically $100,000 but can be increase to $500,000 for about $25. per year…
Many people don’t realize that coverage is there from a homeowners policy. Perfect example is when the columbine incident happened several years ago…the ho policy for the two psycho kids actually paid out policy limits..

In the USA:

Contact your homeowner insurance provider/agent.

Many homeowner policies provide very broad personal liability coverage and may provide coverage for such accidents under their personal liability Section 2 coverages.

Another question to ask your agent is whether or not there is any exclusion for commercial/business activity during which such an accident may occur. Many homeowner policies have broad exclusions for business activity. For example, your policy might provide coverage if you are hunting in Africa on vacation but might exclude coverage {i.e., NOT provide coverage} if you are videoing or writing up the hunt for sale or publication or using the hunt for any business purpose whatsoever.

A suit may not have to occur before payment would be made. The broad liability coverages provided by many insurance policies cover negligent acts and the legal liability that arises from such acts. Such a contract allows for payment for legal liability without a suit being filed. A suit might be filed by one or more individuals if a dispute over legal liability arises. Criminal acts are very likely to be excluded.

It is impossible to state categorically what event or incident might trigger a lawsuit, but many homeowner policies stipulate the duty to defend owed the insured by the company underwriting the policy.

Time to call your agent!!!

Coverage for an injured employee provided by his employer is a completely different issue. In the USA, Workers Compensation insurance is the type commonly carried {or in some cases required by law to be carried} by employers. Once you leave the USA, it is anybody's guess whether an employer carries a similar coverage or whether such coverage is provided by a national health care system. It is possible that in some cases the employer is self-insured to provide medical or other coverage for indemnification of injured workers. Other countries have different systems and/or laws governing legal liability, indemnification, medical costs, pain and suffering, etc, etc. Whatever nationality you are, don't think what IS "here" IS "some place else".

In today's "open border" world it is easy to think that things are the same everywhere a guy puts a boot on the ground.

Suffice it to say; They are NOT.

I see RIPP and I jumped on this one together.

He asks about NRA and SCI. I'm not sure, but maybe somebody has an answer to that.

My mind is jumbling about thinking there might be additional coverage provided by one or both of those organizations but I do not know.

Obviously a call to both would get the info pretty fast.

I know that BASC (British Ass for Shooting and conservation) Sportsmans Association and some others have it free as part of membership. I think that it works out as a cheep way to do it.

I don't know if they accept "country" members but they very well might,

Regards

NRA membership in the UK entitles you to £5million liability insurance when participating in NRA approved activities (i.e. target shooting on NRA affiliated ranges). Overseas cover excludes USA and Canada. Overseas members are covered at NRA events in the UK.

The BASC insurance is better because it offers £10 million liability insurance, including worldwide cover for UK residents excluding USA/Canada. It covers all shooting activities including hunting. Cover for non-UK resident BASC members is limited to BASC events only.

However, a note of caution, the BASC liability cover is limited to £5million when directly/indirectly related to terrorism, so if you decide to shoot Bin Laden when on your markhor shikar in Pakistan, and his family sues you, your cover may be limited!!

Both NRA and BASC insurance is underwritten by Zurich, so maybe they would be worth a call if looking for hunting related liability insurance?...

Does SCI or DSC offer anything for worldwide hunting?

Check with the hunting associations you belong to. Many have insurance cover, including when hunting. The terms and coverage will differ. I have no idea if they provide cover only when hunting or shooting in the country of origin or not.

Secondly if hunting or shooting overseas, travel insurance MAY cover you, or NOT!? Many standard travel insurance policies will EXCLUDE activities such as hunting or mountain climbing etc. Some, a few, WILL COVER hunting/shooting. PHs in particular often pay a lot more for insurance for this sort of cover, but they are also in the business, which is a different category of insurance.

I believe the travel insurance I took out for my last safari covered sporting (not business related) hunting activities as well as good coverage ie $$$ for loss of my firearms (ie double rifles) if they were lost/stolen etc.

If someone on here can provide guidance and pointers in the right direction, great, but best way is to read the policy yourself, and/or ask the organisation the questions directly.

Liability insurance can be important as it is not only accidental shooting of humans which is disastrous, but also eg accidental shooting of valuable animals eg stud animals. I once shot a couple deer in the middle of a horse racing stud where multi-million dollar racing blood stock was visible in the distance BEHIND the deer. I made extremely sure the bullet went right where it was supposed to, and NO chance of a miss, full penetration etc.

As explained by others on this forum, the Sporting Shooters' Association of Australia provides quite comprehensive cover for hunters going overseas. I've used them to insure my upcoming trip to SA and Moz, and found them very helpful. Actuarily, the writing is on the wall, though. To insure myself against all sorts of stuff including kidnapping and probably ebola, with medivac and most property contingencies thrown in, it cost $160. For my best rifle: $400. Fingers crossed ...
