I don't think you need a person to be being physically mauled at the exact moment of the shot, to not be trying to save someone or yourself. Like saying shooting a lion in a charge before it reaches someone is not trying to save someone.

Many jurisdictions I believe have laws requiring people to render aid when there is medical problems, eg a charge for "failing to render assistance". An obvious one is during motor vehicle accidents, especially when the person being charged was involved in the accident.

However I believe the Boddington incident is very different to the example you outlined as shooting at a "deer" without identifying it first as actually a man, is very different from shooting at an attacking leopard without knowing a man was underneath the leopard.

I am not certain exactly where BB was when she shot, but if she was right behind the PH when she shot that would be a problem for me and one more thing added to her list above of potentially negligent actions.

The strange thing about THAT is that at least in my opinion, shooting behind someone IS clearly negligent in almost all cases {you don't know if they will move into the line of fire at the last moment} ...




Maybe the statement tells you what you want to know:

"When I heard Nic’s shot go off I stepped out from behind him ..." BB statement.

"Brittany didn’t know at the time that Punki was under the leopard because she was walking behind me when it happend and when she stepped out behind me, ..." JNK statement.

No need for speculation. As Mac suggested re-read the statements.
