NITRO, I am not trying to summarize Namibian law. In fact, I basically agree with you in regards to the moral portions of your posts. Trying to help, unless you are absolutely sure you cannot help and would do harm instead, seems to me to be far more acceptable a proposition than standing there hoping the critter dies of old age.

However, what I'm saying is how I think the scenario would play out here in my State. And in that respect I think 500grains is absolutely right. Remember, negligence doesn't necessarily mean "wrong". It means "Shit Happens" and you are responsible.

But the "Shit" started "Happening" before she shot, of course, and that is what makes these sorts of situations both interesting and troublesome.

I believe I can both agree with those who say she did the "right thing" {by trying to help} AND those who say she is "negligent".

Remember, tho, she said herself she did not know a man was being attacked {so she wasn't knowingly trying to save a man} AND she fired without knowledge of where the others were AND without being able to fully ID her target or the backstop of her bullet. Those facts would, I think, here, leave her with a percentage of negligence.

I reckon things are different in Namibia and if so, that might be a good thing, morally-speaking, as long as the fellow that was shot is well cared for and indemnified.

Another question:

The PH says;

"Zukile and Punki were walking a short distance in front of me with Brittany right behind me and Simon Elton a couple of steps back."

I am not certain exactly where BB was when she shot, but if she was right behind the PH when she shot that would be a problem for me and one more thing added to her list above of potentially negligent actions.

The strange thing about THAT is that at least in my opinion, shooting behind someone IS clearly negligent in almost all cases {you don't know if they will move into the line of fire at the last moment}, but in this case if it happened, it didn't result in injury to the fellow in front of her. So the thing that is most potentially negligent IMO wasn't the direct cause of damage! HA! One more strange twist and making this an interesting case indeed.

And finally, {here I go again, Duggaboy... } if Punki was in front of the PH, and the whole thing took "3 seconds" to occur, is it possible that BB didn't shoot the fellow, but rather the PH did? Just asking, because it is said that Zukile for some unstated reason fell to the ground {after a close shot...?} and I got to wondering, well...
